The By Charlotte Pty Ltd mobile message service (the "Service") is operated by By Charlotte Pty Ltd (“By Charlotte Pty Ltd”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to By Charlotte Pty Ltd’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of By Charlotte Pty Ltd through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with By Charlotte Pty Ltd. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to bycharlotte or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other By Charlotte Pty Ltd mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Pre-Orders

• Styles marked as Pre-Order will arrive at our warehouse on the specified date listed in the item description.
• If you purchase a Pre-Order item, you will still receive a confirmation for your order once it has been placed.
• You will hear from us again when your Pre-Order item has arrived into our warehouse and is ready to be dispatched.
• We will send then send you a shipping confirmation once it has been shipped.
• You do not need to follow this up, we promise we haven’t forgotten you!
• If you order more than one item, and any one of them is a Pre-Order style, your order will be partially fulfilled with the ready-to-ship items sent first. Pre-Order order styles will be sent at a later date.

Keepsake Collection Locket Pendants Pre-orders

• Estimated arrival 27th June 2023.
• When an order contains multiple items, the order will be partially fulfilled without the locket pendants.
• If a chain necklace is purchased at the same time as the locket pendant, the chain will be shipped together with the locket after the estimated arrival date.
• If you would like to cancel a Pre-Order, please contact customer care with your order number ASAP at customercare@bycharlotte.com.au. Cancellations will not be accepted less than 14 days before the expected arrival date.

Same Day Delivery

• Same Day Delivery is available for customers based in Sydney. Price is subject to your postcode and is calculated at checkout.
• Order by 11am Monday-Friday for delivery on the same day.

Locket Terms and Conditions

Thank you for choosing to purchase a by charlotte Locket. Please read these terms and conditions carefully before making your purchase.

Complimentary Printing Service

• Our Lockets come with a complimentary printing service. Please note that this service is subject to availability and may be withdrawn without notice.
• No Changing Photo: Once you have selected and uploaded your photo, it cannot be changed. Please ensure that you have selected the correct photo before submitting your order.
• One photo per locket order.

Processing Time

• If you opt into our complimentary printing service, please allow 48 – 72 business hours for your order to be processed. This processing time may be extended during peak periods. Excluding same day delivery orders. This will be processed and dispatched on the same day.
• Quality of Images: Please note that the cropping and quality of your images is done in-house and may vary. We will do our best to ensure that your photo looks beautiful in your locket necklace, but we cannot guarantee an exact match to your original photo.
• Colour of Photos: Photos will be printed in colour as supplied. However, please note that due to differences in computer monitors and printers, the colours may vary slightly from what you see on your screen.
• Printing Quality: Your image will be printed in colour on photo paper.

Inappropriate Photos

• We reserve the right to cancel any order that contains inappropriate photos. Inappropriate photos include, but are not limited to, photos that are offensive, obscene, or infringe on the rights of others.
• By purchasing a Locket from our website, you agree to these terms and conditions. If you have any questions or concerns about these terms and conditions, please contact Customer Care at customercare@bycharlotte.com.au before making your purchase.

Your Privacy

• We are committed to protecting your privacy at by charlotte. Once an order is placed with an image attached, the image will be stored on a 3rd party platform until the image is printed and dispatched with your locket. 
• Your image will then be securely deleted from our systems, with only one copy being stored with your order details and protected by encryption on our E-commerce Platform. Your image will not be used for any other purposes without your explicit consent. For more information, please see our privacy policy here.

 Engraving Terms and Conditions

Thank you for choosing to engrave your by charlotte piece. Please read these terms and conditions carefully before making your purchase.

Complimentary Engraving Service

• We offer a complimentary engraving service on a selection of our products. Please note that this service is subject to availability and may be withdrawn without notice.
• Our services include customisation to the words and font of the engraving on the product, and an example or preview will be shown to you prior to purchasing. By viewing the preview, adding a customised product to your cart, and proceeding to checkout, you agree that you are satisfied with the final product and have viewed and checked your engraving message to verify the correct spelling and accuracy of the text.
• All engraved items are considered FINAL SALE and cannot be returned or exchanged under our change of mind policy, unless faulty.
• We are unable to process any engraving requests which contain profanities or inappropriate language, or violate the intellectual property rights of any third party. Where possible, we will contact you to seek an alternative engraving message.
• By purchasing a product with engraving from our website, you agree to these terms and conditions. If you have any questions or concerns about these terms and conditions, please contact Customer Care at customercare@bycharlotte.com.au before making your purchase.

Booking Your Piercing Appointment - Online

• Visit our website at bycharlotte.com.au/pages/piercing studio. Select your desired service, location, and preferred date and time. 

 Please note the following important details

• Cancellation Policy: If you need to cancel your appointment, please do so at least 24 hours in advance to avoid any charges. For cancellations within 24 hours, late arrivals, or no-shows, your deposit will be forfeited.  
• Arrival Time: We kindly ask that you arrive at least 5 minutes prior to your scheduled piercing service appointment. This will give you ample time to complete a waiver/consent form before your session.  

Payment Information 

• Your initial payment will be credited toward your first piercing. Payment for both the jewellery and any additional services is due at the time of your visit.
• Some services may require a credit card payment to reserve an appointment, and in case of a no-show, late arrival, or cancellation with less than 24 hours' notice, the card may be charged accordingly.

 Cancellation & Lateness 

• In case of late attendance, no-shows or cancellations with less than 24 hours' notice, your initial payment/deposit will be forfeited.
  Appointments may be rescheduled up to 24 hours before the booked appointment, however, are subject to availability.
• If you are more than 10 minutes late to your Piercing appointment, your appointment length will be shortened to ensure there is no disruption to the subsequent schedule.  
• If you are more than 15 minutes late, your appointment will need to be rescheduled and the service fee taken at the time of reservation will be forfeited.
• If you do not show up to your booked appointment, we will cancel the appointment and your initial payment/deposit will be forfeited.

 Rescheduling and Changes

• To reschedule or cancel your appointment with more than 24 hours notice, please contact our Sydney Flagship Boutique on (02) 8959 4900.
• We reserve the right to reschedule your appointment at any time and for any reason, without giving you prior notice. If we do, we will return your original payment method with the amount of the booking deposit.
